Abdelrazeg El Murtadi Suleiman

Dr. Abdelrazeg El Murtadi Suleiman (born July 17, 1945) was a Libyan[1] author, law professor, counsel, diplomat, and Former Member of the UN International Law Commission.[2][3][4][5][6][7][8][9][10][11] He served as a legal expert and counsel for Libya and Libyan entities in international cases before several international forums and tribunals. Abdelrazeg also served as a Professor at the Faculties of Law of the Universities of Tripoli and Benghazi and other major Libyan institutions for over 30 years.[12][13][14]

Early Life and Education

Abdelrazeg was born in Al-gegab, Libya. He belongs to the Al Abidat tribe, one of Libya’s largest tribes. He obtained his L.L.B. from the University of Benghazi, Libya, in 1968; a Master of Law from the University of Grenoble, France, in 1971; and a Ph.D. from the University of Paris I/Sorbonne, France, in 1976.[15][16][17][18][19][20]

Career

Academic Career

Between 1976 and 2007, Abdelrazeg taught many subjects in undergraduate and graduate programs at several institutions, including Public International Law and Petroleum Law at the Faculties of Law of the University of Benghazi and the University of Tripoli;[21][22][23][24][16] Private International Law at the Faculty of Law of the University of Tripoli and the Academy of Security Science, Tripoli; and Diplomatic Law at the Institute of Diplomatic Studies, Tripoli.[18][19][20]

He also served as the head and member of committees assessing research papers submitted for promoting university faculty members, supervised theses and post-graduate students' research in Libyan and Arabic universities, and offered several opinions regarding academic matters.

Abdelrazeg participated in several domestic and international academic meetings, seminars, symposiums, and conferences, including at Harvard and NYU universities and other institutions in Europe (Geneva, London, Rome), in Africa (Cairo, Cape Town), and Asia (Cyprus, Bahrain, Beirut) dealing with issues of international law such as human rights, sanctions, the Rome Statute of the International Criminal Court, remnants of wars, and international arbitration.[20][12]

He headed several Libyan committees and boards, including the Continental Shelf Committee (1976-1987), the Drafting Committee of Maritime Areas Law (1988-1990), the Maritime and Land Boundaries Committee (1987-1999), the Petroleum Law Review and Drafting Committee (2005-2006), and the Petroleum Taxation Committee (2006). In addition, he served as a member of the Board of the Libyan Central Bank, the Board of Foreign Investments, the Drafting Committee of the Libyan Constitution, and the Energy Consultative Commission.[15][25][17][19][20][12]

Professional Career

International Court of Justice (ICJ)

Abdelrazeg served as Libya's Agent and Counsel[26] in several international cases before the International Court of Justice (ICJ).[27][20]

Between 1982–1985, he was Libya's Agent before ICJ in the Case Concerning the Continental Shelf (Libya v. Malta)[28][29][30] and its incidental proceedings, Application by Italy for Permission to intervene in the Case in 1984.[23][12][14]

As Counsel, he represented Libya before the ICJ in major cases, including;

  • Case concerning the Continental Shelf: Tunisia v. Libyan Arab Jamahiriya (1978–1982),[24][31][32][33] and its incidental proceedings;[34][12]
    • Application by Malta for Permission to Intervene in the Case, 1981[12]
    • Application by Tunisia for Revision and Interpretation of the Court Judgment of February 24, 1982-1985[12]
  • Questions of interpretation and application of the 1971 Montreal Convention: Libyan Arab Jamahiriya v. United Kingdom, 1992[35] and its incidental proceedings:
    • Request for Indication of Provisional Measures, Libyan Arab Jamahiriya v. United Kingdom, 1992
    • Preliminary Objections, United Kingdom v. Libyan Arab Jamahiriya, 1998
  • Questions of interpretation and application of the 1971 Montreal Convention: Libyan Arab Jamahiriya v. United States, 1992,[21][36] and its incidental proceedings:
    • Request for Indication of Provisional Measures, Libyan Arab Jamahiriya v. United States, 1998
    • Preliminary Objections, United States v. Libyan Arab Jamahiriya, 1998

Consultations/International and Regional Organizations

Abdelrazeg served as a legal expert for the Ad Hoc Committee of the Organization of African Unity (OAU) dealing with the Chad-Libya boundary dispute, in Libreville, in 1977. He also served as an expert to the OAU in drafting the African Union Constitutive Act, Addis Ababa between 1999 and 2000. In addition, he participated in and provided legal advice for the Libyan Delegation to OAU meetings and summits considering boundary issues and the African Union's establishment process.[8][25][17][20][11][12][13][14]

Abdelrazeg also served as a consultant to different Libyan ministries on matters regarding international and regional organizations, the law of the sea (including the United Nations Convention on the Law of the Sea), sovereign and diplomatic immunity, international humanitarian law, international criminal tribunals, and international economic, investment, and the World Trade Organization.[11]

Between 1982 and 1983, he headed the Libyan defense team and served as Counsel in the arbitration proceedings of Mobil Oil Libya, Ltd v., Libyan Arab Jamahiriya. He also was Counsel for Libya and the Libyan National Oil Corporation (NOC) before the International Arbitration Court of the International Chamber of Commerce (ICC) in the cases National Oil Corporation v. Libya Sun Oil Company (ICC Case No 4462 in 1985), and Grace Petroleum Libya v. Libya and National Oil Corporation (ICC Case No 8035) between 1993 and 1995.[25][18][20]

Abdelrazeg also served as the chief negotiator and legal adviser in meetings and negotiations dealing with several legal issues related to the status of boundaries and border areas with neighboring states, technical cooperation, and transfer of technologies under contractual arrangements and joint ventures established with international partners in various sectors including oil and gas, industry, energy, and electricity.

He was a member of the legal defense team of the Organization of the Petroleum Exporting Countries (OPEC), Vienna, in cases against the organization and its members before US Courts. He also provided expert opinions before ICC tribunals on cases involving principles and rules of Libyan law and foreign investors' legal guarantees, including investment agreements and stabilization clauses.[8]

His Arabic publications are available in the libraries of several national universities, including the King Fahad National Library in Saudi Arabia.

Between 2002 and 2017, Abdelrazeg served as a Judge at the Court of Justice of the Arab Maghreb Union. He was the Court's President from 2009 to 2010.[25]

Abdelrazeg also participated in the UN General Assembly's sessions and was a member of the Libyan delegations to its 62nd - 65th Regular sessions, the Libyan Representative to the Sixth Committee (Legal Committee), and a Legal Adviser to the Libyan Permanent Mission at the United Nations between 2007 and 2012. Between 2007 and 2009, he served as Libya's Deputy Representative before the UN Security Council.[25][12]

In 2011, Abdelrazeg was elected by the UN General Assembly to be a member of the UN International Law Commission, where he served until the end of his term in 2016.[5][37][38][19][20]

He has been featured in interviews, including a NY Times interview regarding the Libyan revolution.[39]

Personal Life

Abdelrazeg passed away on June 7, 2021, in London, the U.K., and was survived by his wife and four children.
