Latif had been cleared for release multiple times. US District Court Judge Henry Kennedy mocked the US government for the flimsiness of its justification for Latif's detention. But his ruling was overturned by the DC Circuit Court of Appeals, in what was considered a key ruling. The appeals court ruled that the government's evidence had a "presumption of regularity" -- it had to treated as true, couldn't be challenged.
