John D. Winer (born July 6, 1954) is an attorney and founding partner of Winer, Burritt & Tillis, LLP, one of the leading sexual harassment and abuse (and personal injury/wrongful death) firms with offices throughout the state of California.

Career

John Douglas Winer was born on July 6, 1954 in New Haven, Connecticut. He graduated from Cheshire Academy in 1972. He received his undergraduate degree from University of Florida in 1976 and his law degree from University of San Francisco in 1979. Over the last 40 years, Mr. Winer has represented thousands of victims of sexual harassment and sexual abuse as well as individuals with serious personal and psychological injury and wrongful death cases. During that span, Mr. Winer has received many record-setting verdicts and settlements and is recognized by his peers as an exceptional lawyer. For 13 straight years he has been elected by his peers as a Northern California Super Lawyer (one of the top 5% of lawyers in the state of California) and he has earned Martindale-Hubbell’s AV rating for his high ethical standards.

One of Mr. Winer’s best-known cases was Rahn v. Lowinger which was tried in San Francisco in which he received a $7.3 million dollar verdict for a victim of sexual abuse. In Mr. Winer’s first trial he received a 4.5 million dollar verdict for another victim of sexual abuse in the San Diego case of Walker v. Parzan. Mr. Winer’s $4.2 million dollar judgement in San Jose in a sexual harassment case against FedEx remains one of the highest sexual harassment judgments in Santa Clara County.

In 2000 Mr. Winer was elected president of the prestigious San Francisco Trial Lawyer Association and for 6 years he was elected vice president of the California Trial Lawyers Association/Consumer Attorneys of California.

Mr. Winer was recently a finalist for San Francisco Trial Lawyer of the Year and California Consumer Attorney of the Year.

Mr. Winer has appeared on all of the major television networks throughout California and his cases have been published in all of the major California newspapers including the Los Angeles Times and San Francisco Chronicle. He has also been featured in national publications such as the New York Times and Wall Street Journal.

Mr. Winer has litigated many cases against California colleges and is currently handling a dozen cases against California institutions of higher education including UC Berkeley, USC, UC Riverside, UC Irvine and UC Davis. His sexual harassment lawsuit against the dean of the UC Berkeley Law School garnered national attention.

Personal Life

Mr. Winer is married to criminal defense attorney Shannan Dugan who has handled many significant cases throughout California including the murder trial of People v. Hoskins, a case that she co-tried in Woodland, California with nationally-famed attorney, Tony Serra. In that case, they won acquittal for their client who was tried for second degree murder.

Mr. Winer had 3 children, Nell born in 1990; Haley born in 1993 and Dolci born in 2004. The children are respectively in graduate school, undergraduate school and high school.

Mr. Winer is the lead author of the two-volume legal textbook, Proving Mental and Emotional Injuries: James Publishing, Inc. (2005 with updates) , one of the leading national texts on the subject matter.

He also wrote Chapter 51 on Pain and Suffering in the Mathew Bender 6 Volume Text, California Torts.
